Orders of protection

Eligibility for orders of protection:

A person may file a petition for an order of protection at any time:

  • Against a partner or family member if there is a reasonable apprehension of bodily injury, or if the person is a survivor of specific crimes committed by a partner or family member including but not limited to: assault, aggravated assault, intimidation, criminal or negligent endangerment, assault with a weapon, unlawful restraint or kidnapping.

  • Against someone other than a partner or family member if the person is a survivor of stalking, incest, sexual assault or sexual intercourse without consent, assault, aggravated assault or assault on a minor by respondent.

Where to file a petition:

A person seeking an order of protection may file the petition in any district court, justice court, municipal court, or city court. The following are courts in Gallatin County where a petition may be filed.

  • Gallatin County Justice Court or Gallatin County District Court, located in the Gallatin County Justice Center, 515 S 16th Ave., Bozeman. 

  • Bozeman Municipal Court, located in the Bozeman Public Safety Center, 901 N Rouse Ave., Bozeman. 

  • Belgrade  Municipal Court, 91 E. Central Ave., Belgrade.

  • Manhattan City Court, 207 S. 6th St., Manhattan.

  • Three Forks City Court, 206 Main St., Three Forks.

  • West Yellowstone City Court, 440 Yellowstone Ave., West Yellowstone.
